1. Acceptance of Terms
By downloading, installing, or using Nolar Bear ("the App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use the App. These Terms apply to all users of the App, including caregivers who join a family group via an invitation.
2. Description of Service
Nolar Bear is an iOS application designed to help families privately track baby care activities, including feeding, diaper changes, sleep, growth milestones, pumping sessions, medication, and tummy time. The App uses an invite-only system: one user creates a family group and invites caregivers to join. All tracking data is private to the family group and not visible to any other users or to Nolar Bear.
3. User Accounts
You must create an account with a valid email address to use the App. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at support@nolarbear.com if you suspect unauthorized access to your account.
You must be at least 13 years old to create an account. By creating an account, you represent that you meet this age requirement.
4. Privacy and Child Data
Your use of the App is also governed by our Privacy Policy, available at nolarbear.com/privacy. By using the App, you consent to the collection and use of information as described therein.
The App is designed to track information about infants and young children. You, as the account holder and/or caregiver, are responsible for ensuring that any data you enter about a child is handled in accordance with applicable laws. Nolar Bear does not knowingly collect personal information directly from children under the age of 13.
The App uses Google Firebase for data storage and authentication. Firebase's privacy practices are described at firebase.google.com/support/privacy.
5. User Content
You retain ownership of any content you submit through the App, including tracking entries, notes, growth records, and messages posted on the family message board ("User Content"). By submitting User Content, you grant Nolar Bear a limited, non-exclusive license to store and transmit that content solely for the purpose of providing the App's services to you and your family group.
You are solely responsible for the accuracy of User Content you enter. The App is not a medical device and tracking data should not be used as a substitute for professional medical advice.
6. Acceptable Use
You agree not to use the App to:
 • Share access credentials with individuals outside your family group without their knowledge and consent;
 • Upload or transmit any content that is unlawful, harmful, or violates the rights of others;
 • Attempt to gain unauthorized access to any part of the App or its underlying systems;
 • Use the App in any manner that could disable, overburden, or impair its functionality;
 • Reverse engineer, decompile, or disassemble any part of the App.
7. Not Medical Advice
The App is intended solely as a personal tracking tool and does not constitute medical advice, diagnosis, or treatment. Always seek the advice of a qualified healthcare provider with any questions you may have regarding your child's health. Never disregard professional medical advice or delay seeking it because of something tracked or displayed in the App.
8. Third-Party Services
The App relies on third-party services, including Google Firebase for data storage, authentication, and analytics. Your use of the App is also subject to the terms and privacy policies of these third-party providers. Nolar Bear is not responsible for the practices of these third parties.
9. Intellectual Property
The App and its original content, features, and functionality — including but not limited to the Nolar Bear name, logo, mascot, and design — are owned by Nolar Bear and are protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App without our prior written consent.
10. Disclaimers
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. NOLAR BEAR DOES NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
11. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, NOLAR BEAR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR PERSONAL INJURY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP, EVEN IF NOLAR BEAR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN WARRANTIES OR LIABILITY, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
12. Termination
We reserve the right to suspend or terminate your access to the App at any time, with or without cause, and with or without notice. You may delete your account at any time through the App settings. Upon termination, your right to use the App will immediately cease.
13. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by updating the effective date at the top of this page and, where appropriate, through a notice within the App. Your continued use of the App after any changes constitutes your acceptance of the updated Terms.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States and the state in which Nolar Bear is based, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in that jurisdiction.
